1. Identification of the parties

These terms and conditions govern the relationship between:

And any user (hereinafter, “the User”) who accesses, browses, or uses the Mencoro platform and its services.

2. Purpose of the platform

Mencoro is an AI-powered SEO rank tracking platform that provides keyword monitoring, search visibility analytics, competitor analysis, and AI search optimization tools. Access to certain features requires registration and subscription to a paid plan.

3. Acceptance of terms

By accessing or using the Mencoro platform, the User agrees to be bound by these terms and conditions. If the User does not agree with any provision, they must discontinue use of the platform immediately.

Mencoro reserves the right to modify these terms at any time. Modifications take effect upon publication on the platform. Continued use after changes constitutes acceptance of the updated terms.

4. Account registration

4.1 Requirements

To access Mencoro services, Users must:

• Be a legally aged natural person or a valid legal entity under Spanish law
• Provide truthful and complete registration information
• Maintain a single account per person or entity
• Accept the Privacy Policy and these Terms & Conditions

4.2 User responsibilities

The User agrees to:

• Keep login credentials confidential and not share them with unauthorized parties
• Maintain accurate and up-to-date account information
• Accept sole responsibility for all activities conducted under their account
• Notify Mencoro immediately of any unauthorized use of their account

4.3 Account modification and cancellation

Users may modify their account data or cancel their subscription at any time through their account settings. Account cancellation does not entitle the User to a refund of any prepaid subscription fees unless otherwise stated in the applicable plan terms.

5. Service description and subscription

5.1 Plans and pricing

Mencoro offers subscription plans with varying features and usage limits. Plan details, pricing, and included features are described on the pricing page. All prices are displayed inclusive of applicable taxes.

5.2 Billing and payment

Subscriptions are billed on a recurring basis (monthly or yearly) according to the selected plan. Payment is processed through our third-party payment provider. The User authorizes automatic recurring charges until the subscription is canceled.

5.3 Refund policy

Subscription fees are generally non-refundable. If the User cancels during a billing period, access remains active until the end of the paid period. No partial refunds are issued for unused time within a billing cycle.

5.4 Service modifications

Mencoro reserves the right to modify, suspend, or discontinue features of the platform with reasonable notice. Significant changes to paid features will be communicated to affected subscribers in advance.

6. Acceptable use

The User agrees not to:

• Use the platform for any illegal activity or in violation of applicable laws
• Share login credentials with unauthorized third parties
• Attempt to gain unauthorized access to other accounts or platform systems
• Reproduce, distribute, or commercially exploit platform content without prior written consent
• Introduce malware, viruses, or any harmful code into the platform
• Use automated systems (bots, scrapers) to access the platform beyond its intended API usage
• Employ reverse engineering techniques on the platform
• Use the platform in any way that could damage, disable, or impair its operation
• Resell or redistribute data obtained through the platform without authorization

7. Intellectual property

7.1 Platform ownership

All intellectual and industrial property rights over the Mencoro platform, including its design, source code, algorithms, graphics, text, trademarks, and trade names, belong exclusively to Virality Media, S.L. or are used under valid license.

Any reproduction, distribution, public communication, or transformation of platform content requires prior written consent from the Company.

7.2 User content

Users retain ownership of data they upload to the platform (such as website URLs, keyword lists, and project configurations). By using the platform, the User grants Mencoro a limited, non-exclusive license to process this data solely for the purpose of providing the contracted services.

8. Data accuracy and limitations

Mencoro provides SEO rank tracking data and analytics based on publicly available search engine results. While we strive for accuracy:

• Ranking data may vary based on location, device, personalization, and other search engine factors
• Data is provided for informational purposes and should not be the sole basis for business decisions
• Mencoro does not guarantee specific SEO results or search engine rankings
• Third-party data sources may experience delays or inaccuracies outside our control

9. Platform availability

Mencoro strives to maintain continuous platform availability but does not guarantee uninterrupted access. The platform is provided “as is” and may be subject to:

• Scheduled maintenance windows
• Temporary disruptions due to technical issues
• Force majeure events beyond the Company’s reasonable control

Mencoro will make reasonable efforts to minimize downtime and notify Users of planned maintenance in advance.

10. Limitation of liability

To the maximum extent permitted by applicable law:

• Mencoro shall not be liable for indirect, incidental, consequential, or punitive damages arising from the use or inability to use the platform
• Mencoro’s total liability shall not exceed the amount paid by the User in the 12 months preceding the claim
• Mencoro is not responsible for decisions made based on data provided by the platform
• Mencoro is not liable for actions of third-party service providers integrated with the platform

11. Sanctions and termination

11.1 Violations

Mencoro may suspend or terminate User accounts that violate these terms, without prior notice in cases of serious breach. Suspension or termination does not entitle the User to compensation.

11.2 User-initiated termination

Users may terminate their account at any time through their account settings. Termination does not relieve the User of outstanding payment obligations.

12. Indemnification

The User agrees to indemnify and hold harmless Virality Media, S.L. from any claims, damages, losses, or costs (including legal fees) arising from:

• The User’s breach of these terms
• The User’s violation of applicable laws or third-party rights
• The User’s use of the platform

13. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be interpreted to reflect the original intent as closely as possible under applicable law.

14. Applicable law and jurisdiction

These terms are governed by Spanish law. For disputes involving consumers, the courts of the User’s domicile shall have jurisdiction in accordance with applicable regulations. For non-consumer disputes, the parties submit to the exclusive jurisdiction of the courts of Cornella de Llobregat, Barcelona.

The Spanish version of these terms prevails in case of discrepancy with translations into other languages.
